US Supreme Court Hears Case Challenging Fair Share/Agency Fees

Today, the United States Supreme Court heard oral argument in Harris v. Quinn.The case itself concerns homecare workers in Illinois who are considered state employees under that state’s collective bargaining laws.More broadly, Harris has the potential to significantly change the manner in which agency fees can be administered by labor unions throughout the country, including here in California. As we previously explained, in Knox v. Schwarzenegger,in 2011, the conservative majority on the Supreme Court made multiple comments that suggested it was looking to dramatically change, if not completely eliminate, agency fee arrangements under the guise of protecting First Amendment rights.After speaking with the attorneys representing SEIU in Harris, we put together a nationwide coalition of unions and associations who represent approximately a million public safety employees on behalf of the following associations:

Pensions for city workers can't be cut, but pay can, judge rules in major San Jose case

SAN JOSE -- In a landmark ruling that could help shape city budgets around the state, a judge invalidated key parts of San Jose's voter-approved pension cuts but upheld other elements that could still save huge taxpayer costs.

Santa Clara County Superior Court Judge Patricia Lucas' tentative decision released Monday prohibits the city from forcing current employees to contribute significantly more toward their pensions, as called for in last year's Measure B. But the ruling allows the city to cut employees' salaries to offset its increasing pension costs.

Kentfield Fire District Mourns Loss of Carol Abraham

November 20, 2013

To our extended fire service family: it is with great sadness that Kentfield Fire Protection District announces the death of Carol Abraham. Carol passed away on November 19, 2013 after a courageous battle with cancer.

Carol joined the Kentfield Fire District in September 1982 in the administrative office of the District. She served with great dedication and a smile every day, until her retirement in 2011. Carol was well respected by her peers and was very active during her tenure in the Administrative Services Section of the California Fire Chiefs Association.

Her husband, Henry, and daughters Linda and Victoria survive Carol. Memorial services and any additional information will be posted on the District webpage atwww.kentfieldfire.org, when available.

Local 1775 Members:  Gregg Adam, of CBM Law, is one of our union and association attorneys, and regularly attends Local 1775 meetings.  He is among our strongest supporters and a true advocate for firefighters and public employees, and has been recognized for his efforts.
 
CBM is pleased to announce Public Sector Labor Partner Gregg Adam has been selected for inclusion in the Daily Journal’s Top 20 Municipal Lawyers.  The Daily Journal describes this select group of California lawyers as “unsung legal heroes” in a wide range of practice areas.  Gregg was the only union-side lawyer selected amonst this year's group. New NIOSH Study Reinforces Link Between Fire Fighting and Cancer

A new study conducted by the National Institute of Occupational Safety and Health (NIOSH) on mortality and cancer incidence in career fire fighters shows an elevated risk of several types of cancer - and of all cancers combined - compared to the general U.S. population.  

The just-released study, published in the Occupational & Environmental Medicine, is among the largest examining cancer risk in career fire fighters, with a study population of 30,000 fire fighters from IAFF locals in Philadelphia, Chicago and San Francisco.  

The study identified higher incidence rates of cancers of the respiratory, digestive and urinary systems, which suggest that fire fighters are more likely to develop these cancers compared to the general U.S. population. The incidence rate of mesothelioma was two times greater among fire fighters compared to the general population, indicating likely occupational exposures to asbestos, the known cause of mesothelioma.

IAFF Pushes Back Against Formal Ties to Liberal Groups

IAFF General President Harold Schaitberger and other AFL-CIO affiliate leaders are among the more than 1,650 delegates attending the 2013 AFL-CIO Convention in Los Angeles, California, this week. General President Schaitberger has been forcefully representing the IAFF as delegates debate more than 50 resolutions, including a resolution to expand membership beyond unions to bring in social and like-minded organizations.

The IAFF is pushing back against this idea that the American labor movement become part of a social liberal movement, publicly expressing concerns about putting social causes before the representation of members. While many other AFL-CIO unions want to take up social issues, the IAFF remains focused on the International's core mission --- to represent professional fire fighters and paramedics and protect their rights and safety in the workplace and improve their lives and livelihoods.

LA Times: Prescott Cheapskates Families of Fallen Heroes

In June, 19 firefighters from Prescott’s Granite Mountain Hotshot Crew were killed fighting a wildfire near Yarnell, Ariz. Six of the men were full-time city employees and their families are entitled to full-time survivors benefits. The other 13, though, were part-time. The city has a special category for those families: out of luck.

Marinwood and San Rafael Agree to Share Services

The Marinwood Community Services District Board of Directors voted 3-1 Tuesday, with Director Leah Kleinman-Green absent and Director Bill Hansell dissenting, to ink a deal with San Rafael after more than five months of negotiations. The agreement allows the departments to share employees and equipment, and eliminates boundaries separating the departments. Now the closest available unit will be dispatched to an emergency.
